RE: Variance Request 20; Reroute of the Project Alignment from Normandie, 120th, and Western Avenues, in Los Angeles County, to the Union Pacific Railroad Right-of-Way.
Dear Mr. Shauers:
We have reviewed the above-referenced variance request, and approve your request based on the following factors:
• The original route (Normandie, 120th, and Western Avenues) was chosen to avoid crossing a hazardous waste site (former landfill) traversed by the Union Pacific Railroad right-of-way (proposed realignment). On November 13, 1997, the California Environmental Protection Agency, Department of Toxic Substances Control (DTSC) concurred that installation of the pipeline within the proposed realignment could occur in accordance with the procedures in the approved Construction Contingency Plan; no additional sampling or site specific measures would not be necessary prior to construction.
• The subject reroute would avoid and/or minimize construction and operation impacts to the residences and businesses along Normandie, 120th, and Western Avenues.
• By rerouting the pipeline to the Union Pacific Railroad right-of-way, the resultant length of pipe to be installed would be reduced from 3987 feet to 2700 feet; thereby, reducing construction impacts in the area.
• The following measures shall be implemented:
- All applicable mitigation measures for the project shall be implemented for construction of the reroute, including the Construction Contingency Plan for the area.
- A notice to excavate shall be provided to DTSC at least two weeks prior to the commencement of construction activities. A copy of the notice to excavate to be provided to DTSC shall also be provided to the Lead Environmental Monitor at the time of submittal to DTSC.
- The soil cap over the subject area shall not be penetrated without prior approval from DTSC and the California Department of Transportation.
- Training shall be provided to all construction personnel and field monitors (including the CPUC Lead Environmental Monitor) who will be present during excavation activities, alerting them of the potential for volatile organic vapors, waste materials, construction debris, and oil field wastes. Training shall also include a description of the appropriate measures to be implemented in the event such substances are encountered. Training shall be conducted prior to excavation activities within the subject area.
- Transportation Management Plans shall be modified to reflect the reroute and approved by the County of Los Angeles, prior to the commencement of construction.
- If during construction any evidence of contamination is encountered, the contractor/PPSI shall immediately notify DTSC and the CPUC Lead Environmental Monitor.
