BIOLOGICAL RESOURCES MITIGATION MEASURES

Mitigation Measure B-V-1: Prior to construction, the location of sensitive botanical resources shall be depicted and designated for avoidance on project construction plans. In the Angeles National Forest, this effort shall include designation of all previously undisturbed areas outside of the existing (recovering) disturbed areas in the Mobil (M-70) or other existing corridors as off-limits to any construction disturbance. This effort shall also include a detailed tabulation of riparian habitats, wetlands, and jurisdictional wetlands (per Army Corps of Engineers, ANF, and CDFG regulations and guidance) potentially to be disturbed by the Proposed Project on a drainage-by-drainage basis, noting which areas are subject to Section 404 and CDFG Streambed Alteration Agreement requirements. Resources to be mapped, where present, shall include riparian habitat, wetlands, and jurisdictional wetlands, oak trees greater than 4 feet tall, other native specimen trees greater than 6 inches dbh, stands of native perennial grasses, Bakersfield cactus, and Peirson's morning-glory.

Flagging and resource avoidance shall be verified by a qualified specialist acceptable to the CPUC and the ANF, CDFG, or other jurisdiction, as applicable. Construction within the driplines of oak trees, and incidental trimming or damage to trees along the proposed route shall be evaluated by a qualified arborist, who shall identify appropriate measures to minimize tree loss. Oaks or native specimen trees that are removed or killed as a result of construction or other project-related activities shall be replaced at a minimum ratio of ten trees of the same species, at least 5 years old and capable of surviving without further maintenance, for each tree removed. Compliance shall be evaluated 5 years after tree removal. Trees shall be planted at locations acceptable to the landowner or managing agency. If the removal of native trees cannot be avoided, transplanting may be attempted at PPSI's discretion and subject to the approval of a designated transplant site by the landowner or managing agency. All planting and transplanting locations, procedures, and results shall be evaluated by a qualified arborist. All protection and replacement measures shall be consistent with applicable local jurisdiction requirements, such as the Los Angeles County Oak Tree Ordinance, and with permit requirements imposed by the CDFG or U.S. Army Corps of Engineers. Tree removal shall not be permitted until replacement trees have been planted or transplanting sites are approved.

Impact: Sensitive species and resources adjacent to the proposed route may be removed or degraded by construction, maintenance, repair, or emergency response (Class I or II).

Performance Criteria, Violation Level, and Timing:

PC1 PPSI to provide botanical survey reports prior to start of construction for review by CPUC/ANF designee prior to start of construction. (Level 1) - Prior to construction.

PC2 Resource avoidance sites flagged and designated prior to start of construction. (Level 2) - Prior to construction.

PC3 Construction activities avoid all sensitive resources. (Level 3) - During construction.

PC4 PPSI provides report from qualified arborist evaluating potential impacts to oak trees, prior to start of construction and when oak trees are trimmed or damaged during construction. (Level 1) - Prior to construction.

PC5 PPSI provides report from qualified arborist evaluating planting and transplanting locations and procedures after replacement trees are planted. (Level 1) - After replacement trees are planted.

PC6 PPSI provides report from qualified arborist evaluating results of planting, transplanting and procedures after replacement trees are planted. (Level 1) - After replacement trees are planted.

PC7 Replacement of oak trees greater than 4 feet tall or native specimen trees greater than 6 inches dbh shall be planted at a ratio of 10:1. (Level 1) - After replacement trees are planted.

Effectiveness Criteria: Sensitive resources are either fully avoided, or resource restoration is implemented. Replacement trees, at least 5 years old, must be successfully established, requiring no further maintenance.

Effectiveness Timing: (1) Plans developed and approved prior to construction; (2) resource avoidance and restoration confirmed during and after construction. Locating and ordering replacement trees must be initiated prior to tree removal.

Mitigation Measure B-V-2: During pipeline construction, the upper 6-12 inches of topsoil, depending on existing depth of topsoil, shall be salvaged and replaced wherever the pipeline is trenched through open land, including shared pipeline and utility corridors, but not including graded roads and road shoulders. Prior to permit issuance and final design, project construction plans shall depict appropriate measures for topsoil protection. Topsoil shall not be used to backfill the trench, and excavated trench spoils or excess fill shall not be dispersed onto the surface of the ROW. Implementation of this measure during construction shall be verified by a qualified specialist acceptable to the CPUC and the ANF, CDFG, or other jurisdiction, as applicable.

Impact: Construction, maintenance, or repair may result in a loss of topsoil, reducing the likelihood of successful revegetation and erosion control. Disposal of trench spoils onto the surface may have similar effects. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 PPSI shall instruct clearing and grading operators to salvage 6 inches and no more than 12 inches of topsoil in all open lands including shared pipeline and utility corridors, but not including graded roads and road shoulders. (Level ) - Prior to construction.

PC2 Construction plans depict appropriate measures (for example, store separately), for topsoil protection. (Level 1) - Prior to construction.

PC3 Topsoil is set aside and protected during construction, is not used to backfill trench, and is dispersed on surface of ROW where it came from after trench filling. (Level 3) - During construction.

PC4 Topsoil not transported from one area to another. (Level 3) - During construction.

PC5 Topsoil not stripped when soil saturated or windy (See Mitigation Measure A-1, PC7 and PC8). (Level 3) - During construction.

PC6 Trench spoils or excess fill not dispersed on surface of ROW. (Level 3) - During construction.

Effectiveness Criteria: No loss of topsoil, disposal of excess spoil or rock fill only within trench or at offsite locations approved by local jurisdiction.

Effectiveness Timing: Plans reviewed, approved prior to final design; monitored during and after construction.

Mitigation Measure B-V-3: Prior to construction, site-specific short- and long-term erosion control measures to be implemented along each portion of the ROW, especially in sensitive areas like West Liebre Gulch, shall be depicted on project construction plans and in PPSI's Erosion Control, Revegetation, and Landscaping Plan (LWRC, 1994a). These plans shall address all drainage crossings as well as areas of steep topography. These plans shall detail the installation of structures or materials as necessary to prevent the erosion and transport of sediment from the construction ROW into off-ROW areas. USDA Forest Service Best Management Practices shall be implemented to control erosion and protect water quality on National Forest lands. Implementation of this measure during construction shall be verified by a qualified specialist acceptable to the CPUC and the ANF, CDFG, or other jurisdiction, as applicable.

Impact: During and after construction, erosion may impede ROW restoration and adversely affect off-ROW habitats at drainage crossings and in areas of steep topography. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 ECRLP and construction plans include and depict site-specific erosion and sedimentation control measures for the entire ROW, including ancillary sites. (Level 1) - Prior to construction.

PC2 USDA Forest Service Best Management Practices are implemented to control erosion and protect water quality on National Forest lands. (Level 3) - During construction.

PC3 ECRLP is implemented during construction. (Level 3) - During construction.

Effectiveness Criteria: Containment of sediment within ROW, no large areas of bare soil or rilling/gullying.

Effectiveness Timing: Plan review and approval prior to final design and route approval; implementation monitored during construction; performance evaluation for up to 5 years following construction.

Mitigation Measure B-V-3*: Replace any trees removed or damaged as a result of project construction and operations in accordance with local jurisdictional requirements. At a minimum, the following shall be implemented, subject to approval by the affected jurisdictions.

(a) Identify on ROW maps and enumerate (in conjunction with measure B-V-2), all native specimen trees (greater than 6 inches dbh) and oaks greater than 4 feet in height or larger than one inch dbh within and bordering the proposed ROW. Monitoring during and immediately after construction shall establish the extent of damage, if any, to oaks and native specimen trees. Trees severely damaged or destroyed by the project shall be replaced, within the legal SPRR ROW or at other locations acceptable to the CPUC and local jurisdictions, at a minimum ratio of 10 vigorous saplings, which have survived at least 5 years in the ground and are capable of surviving without further maintenance, for each specimen tree removed.

(b) Alternatively, transplanting may be used to mitigate potential tree losses, subject to the acceptance of the transplant location by the CPUC and local jurisdiction, and the same 5-year monitoring and maintenance requirements. Prior to construction, replanting sites sufficient to accommodate all foreseeable losses of trees shall be specified in PPSI's Erosion Control, Revegetation, and Landscaping Plan.

Impact: Damage to or removal of native trees greater than 6 dbh, or oaks greater than 4 feet tall or 1 inch dbh.

Performance Criteria, Violation Level, and Timing:

PC1 ROW maps identify locations of native specimen trees (>6"dbh) and oaks >4' tall or >1" dbh. (Level 1) - Prior to construction.

PC2 PPSI provides reports from qualified arborist or reclamation specialist on extent of damage to native specimen trees and oaks. (Level 2) - During construction.

PC3 Specimen trees and oaks severely damaged or destroyed (as determined by qualified arborist or reclamation specialist) are replaced at a ratio of 10:1 with vigorous saplings of the same species as the damaged or destroyed trees. (Level 1) - During construction.

PC4 ECRLP specifies replanting sites sufficient to accommodate all foreseeable losses of trees. (Level 1) Prior to construction.

PC5 ECRLP implemented during construction. (Level 3) - During construction.

Effectiveness Criteria: Planted trees vigorous after 5 years.

Effectiveness Timing: Prior to, during, and after construction; monitoring continues during operations.

Mitigation Measure B-V-4: Prior to construction, PPSI's Erosion Control, Revegetation, and Landscaping Plan shall be revised to specify and plan, by milepost, the seed mixes and their collection and methods of application to be used in revegetation. Each seed mix shall consist of native species collected from natural stands of native vegetation immediately adjacent to the pipeline route. The seed must be handled and applied properly to assure germination, with appropriate follow-up care to assure re-establishment. Along roadsides, the landowner or managing agency may approve alternative mixes or impose its own requirements for revegetation.

Impact: Use of seed mixes lacking locally collected native species, may result in ineffective revegetation and degradation of neighboring plant communities. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 ECRLP has appropriate proposed seed mixtures, collection methods, identification and storage methods, and application methods (as determined by CPUC/ANF designee). (Level 2) - Prior to construction.

PC2 PPSI provides documentation that seeds were collected immediately adjacent to ROW. (Level 1) - After seed collection.

PC3 PPSI provides verification from qualified botanist or reclamation specialist that seeds were handled and applied properly to assure germination. (Level 3) - During and immediately after revegetation at each site.

PC4 PPSI provides to CPUC/ANF designee a detailed plan for follow-up care of revegetated area to assure re-establishment of native species. (Level 1) - Prior to construction.

PC5 PPSI implements approved revegetation plan. (Level 3) - During construction and revegetation.

PC6 PPSI provides to CPUC/ANF designee documentation from landowners or managing agencies when alternative mixes or alternative requirements for revegetation have been imposed by the landowners or managing agency. (Level 3) - Prior to revegetation.

Effectiveness Criteria: Seed mixes contain only native, locally collected species, except along roadsides as approved by local jurisdiction; no erosion/sedimentation impacts to native vegetation.

Effectiveness Timing: Seed mixes approved prior to construction, application verified during construction.

Mitigation Measure B-V-4*: Revise and implement the Applicant's Erosion Control, Revegetation, and Landscaping Plan. The plan describes a series of erosion control measures that may be used at the discretion of the construction-phase environmental supervisors working for Pacific Pipeline. After review and approval by appropriate agencies and affected jurisdictions, and prior to construction, these measures shall be finalized on construction drawings for all portions of the Proposed Project. Field improvisations of these approved measures would not be permitted without the written approval from CPUC and ANF and the affected jurisdictions which could be provided by an authorized onsite representative of these agencies. Construction across all intermittent to perennial stream channels shall occur during seasonal periods of low flow (May to November).

Impact: Potential erosion/sedimentation impacts on native vegetation as a result of construction.

Performance Criteria, Violation Level, and Timing:

PC1 ECRLP has complete and appropriate description of erosion control measures that may be used, as determined by PPSI and reviewed and approved by CPUC/ANF designee. (Level 1) - Prior to construction.

PC2 Approved erosion control measures finalized on construction drawings. (Level 2) - Prior to construction.

PC3 Field improvisations undertaken only with prior written approval from CPUC and ANF and affected jurisdictions. (Level 3) - During construction.

PC4 Construction across all intermittent to perennial stream channels occurs during season of low flow (May to November). (Level 3) - During construction (dry season only).

Effectiveness Criteria: Measures installed according to approved plans.

Effectiveness Timing: Plans finalized prior to construction; implemented during construction.

Mitigation Measure B-V-5: Prior to construction, PPSI's Erosion Control, Revegetation, and Landscaping Plan shall be revised to incorporate monitoring procedures and minimum performance criteria to be satisfied for erosion control and revegetation. Appropriate remedial measures are to be identified if performance criteria are not met. In addition, PPSI shall post a performance security with the CPUC and ANF, the refunding of which shall be linked to the attainment of these performance criteria. The amount of the performance security shall be determined by the CPUC and ANF in consultation with affected landowners and managing agencies and will be commensurate with the estimated costs of the mitigation.

Impact: Unanticipated circumstances or failure to properly implement construction mitigations may cause poor revegetation or weed infestations. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 ECRLP revised to incorporate monitoring procedures and adequacy of performance criteria for erosion control and revegetation and identifies appropriate remedial measures if performance criteria are not met. (Level 1) - Prior to construction.

PC2 PPSI provides proof of performance security. (Level 3) - Prior to construction.

Effectiveness Criteria: To be developed in ECRLP and in agencies' criteria for release from performance security.

Effectiveness Timing: During and after construction; upon request for release from PPSI.

Mitigation Measure B-V-6: Prior to operation of the pipeline, PPSI's Oil Spill Contingency Plan (see System Safety Mitigation Measure SS-13) shall incorporate site-specific measures to protect sensitive species and habitats from oil spill damage, to minimize damage from response and repair operations, and to restore native plant and animal communities to pre-spill conditions. Equipment storage areas and mobilization procedures for each portion of the pipeline shall be described. Emergency diversion and containment measures to minimize the flow of oil into colonies of sensitive plant species shall be developed to protect the Bakersfield cactus at EMP 7 and Peirson's morning-glory at EMP 52-54, and at any other locations where sensitive plant species are discovered in pre-construction surveys. Non-destructive cleanup and restoration procedures shall also be described for these areas. Habitat restoration procedures in all areas shall be consistent with mitigation measures B-V-1 through B-V-5.

Impact: Oil spilled in the unlikely event of a break in the pipeline may extend off-ROW, contaminating soil and causing damage or mortality to sensitive plant species and communities.(Class I or II)

Performance Criteria, Violation Level, and Timing:

PC1 OSCP incorporates site-specific measures to protect sensitive species and habitats, to minimize damage from response and repair, and to restore to pre-spill conditions. (Level 1) - Prior to pipeline operation.

PC2 OSCP describes equipment storage and mobilization procedures. (Level 1) - Prior to pipeline operation.

PC3 OSCP describes non-destructive clean-up and restoration processes consistent with B-V-1 through B-V-5. (Level 1) - Prior to pipeline operation.

Effectiveness Criteria: Effectiveness should be re-evaluated after an oil spill, OSCP revised if necessary. Restoration criteria consistent with ECRLP.

Effectiveness Timing: OSCP completed and approved prior to operations; effectiveness reviewed following implementation in response to an oil spill.

Mitigation Measure B-V-7: As part of PPSI's Erosion Control, Revegetation, and Landscaping and Oil Spill Contingency Plans, PPSI shall include a section describing the coordination and integration of PPSI's mitigation measures with the construction, routine maintenance, and emergency procedures of other operators sharing common corridors with PPSI. PPSI shall identify any circumstances where another operator's practices may constrain mitigation effectiveness, and, prior to construction, shall negotiate agreements regarding maintenance and emergency procedures to be implemented in these shared areas.

Impact: Maintenance, repair, or emergency response procedures of other occupants of PPSI, shared utility corridor cause removal or degradation of botanical resources along PPSI ROW. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 PPSI provides a list of all other operators sharing common corridors, with updated lists provided quarterly. (Level 2) - Prior to construction through operational life of pipeline.

PC2 ECRLP contains section describing coordination with other operators sharing common corridors with PPSI. (Level 1) - Prior to construction.

PC3 OSCP describes coordination with other operators sharing common corridors with PPSI. (Level 1) - Prior to pipeline operation.

PC4 PPSI identifies and reports circumstances where another operator's practices constrain mitigation effectiveness. (Level 2) - Prior to pipeline operation.

PC5 PPSI provides agreements with other operators regarding maintenance and emergency procedures for shared areas in situations where the practices of another operator constrain mitigation effectiveness (as identified under PC4). (Level 1) - Prior to pipeline operation.

Effectiveness Criteria: Coordination plan must account for and resolve all potential conflicts to the satisfaction of responsible agencies (no surprises).

Effectiveness Timing: Coordination plan of ECRLP approved prior to construction, OSCP element approved prior to operations.

Mitigation Measure B-V-8: Prior to removal of the pipeline pursuant to abandonment on National Forest System lands, the project alignment shall be surveyed and a corresponding description of the vegetation and any sensitive plant species present prepared by a ANF-approved botanist. This description shall provide the basis for implementing Mitigation Measures B-V-1 through B-V-5 and B-V-7 as applicable to pipeline abandonment.

Impact: Removal of pipeline as required for abandonment on ANF land may have impacts similar to those of construction, and may affect species whose status has changed in the years since construction. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 PPSI provides survey reports prepared by a qualified botanist with description of the vegetation and any sensitive plant species on National Forest lands. (Level 2) - Prior to abandonment of pipeline on ANF.

PC2 Mitigation Measures B-V-1 through B-V-5 and B-V-7 as applicable to pipeline abandonment. (Level 2) - Prior to and during abandonment of pipeline on ANF.

Effectiveness Criteria: New performance criteria to be developed.

Effectiveness Timing: Upon PPSI notification of intent to abandon per ANF requirements.

Mitigation Measure B-V-9*: Implement all mitigation measures applicable to construction for vegetation or ground-disturbing activities associated with pipeline inspection, maintenance, repair, or pipeline modification during operations. To the extent feasible, these measures shall also be implemented pursuant to habitat restoration in the event of an oil spill.

Impact: Operational activities disturbing vegetation.

Performance Criteria, Violation Level, and Timing:

PC1 PPSI provides documentation of implementation of mitigation measures applicable for vegetation or ground-disturbing activities that are associated with pipeline inspection, maintenance, repair, or pipeline modification during operations (for example: vehicle traffic, air quality, biological resources, environmental contamination, etc.) (Level 3) - During pipeline operation and during habitat restoration after an oil spill.

Effectiveness Criteria: Successful restoration of disturbed habitats.

Effectiveness Timing: Implementation during and after maintenance, repair, or pipeline modification during operations.

Mitigation Measure B-AQ-1: Environmental monitors acceptable to the CPUC and the ANF, CDFG, or other jurisdictions, as applicable, shall be present during all earth moving activities within streams, both perennial and intermittent. The monitors shall make sure that the limits of the corridor are clearly marked and that all work remains within these limits. The monitors shall also ensure that all construction equipment maintenance, including refueling and lubrication, occurs at least 0.25 mile from the nearest stream or wetland. Turbidity in flowing streams shall be monitored downstream of the crossings up to a distance of 1,000 feet or to the point where an increase can no longer be detected when compared to the turbidity samples taken immediately upstream of the corridor for comparison. If increased turbidity extends farther downstream, the distance where turbidity is still observable shall be noted (as access permits). When there is a measurable difference between upstream and downstream turbidity, remedial measures as appropriate, such as alteration of construction methods or installation of silt fences or straw bales, shall be implemented. These measures shall be specified in the Storm Water Pollution Prevention Plan, required by the Regional Water Quality Control Board, to be reviewed and approved prior to construction, and where applicable, any necessary U.S. Army Corps of Engineers Section 404 and/or CDFG Streambed Alteration Agreement requirements.

Impact: During and after construction, erosion may occur at stream crossings and cause downstream sedimentation such that downstream aquatic habitats are substantially altered. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 PPSI provides to CPUC/ANF designee site specific crossing plans and detailed drawings for all perennial and intermittent stream crossings for approval. (Level 3) - Prior to construction.

PC2 PPSI has environmental monitors present during all earth moving activities within perennial and intermittent streams. (Level 3) - During construction.

PC3 Construction corridor at wetlands and stream crossings clearly marked. (Level 3) - During construction.

PC4 All work at wetlands and stream crossings occurs within construction corridor. (Level 3) - During construction.

PC5 All equipment maintenance occurs at least 0.25 mile from any wetland or stream. (Level 2) - During construction and operation.

PC6 PPSI monitors turbidity in flowing streams at a distance of 1,000 feet or to the point where an increase can no longer be detected when compared to the turbidity samples taken immediately upstream (which ever is greater), record results including distance at which sample was taken, and keep water samples. (Level 2) - During construction.

PC7 Remedial measures (as specified in the Storm Water Pollution Prevention Plan) implemented when there is a measurable increase in turbidity downstream than upstream. (Level 3) - During construction.

PC8 PPSI provides approved Storm Water Pollution Prevention Plan. (Level 1) - Prior to construction.

Effectiveness Criteria: Containment of sediment within ROW.

Effectiveness Timing: During and after construction

Mitigation Measure B-AQ-2: Complete construction through or over all streams during the dry season (normally May through October) and prior to 1 November, including backfilling and soil stabilization. Revegetation work and emergency maintenance/repairs can occur after 1 November, as needed.

Impact: Construction or maintenance in streams or wetlands would degrade the aquatic habitats within the construction corridor. Vegetation and streambed substrate would be removed and the natural flow would be diverted. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 Construction through or over streams (for which any impaction the stream could be anticipated) occurs during dry season (May 1 through October 31) and prior to November 1. (Level 2) - During construction.

PC2 PPSI notifies CPUC/ANF designee and provides documentation why revegetation work and emergency maintenance/repair is necessary at streams after November 1. (Level 3) - During construction and post-construction.

Effectiveness Criteria: Banks are stable; sediment is contained so as not to adversely affect aquatic habitats. Revegetation is initiated.

Effectiveness Timing: Plan review and approval prior to final design; implement during the dry season; implementation monitored during construction. Emergency maintenance/repairs can occur after November 1 as needed.

Mitigation Measure B-AQ-3: Use silt curtains or other sediment catchment devices along with erosion control, contour and bank restoration where possible, and revegetation procedures at the following stream crossings: unnamed drainage no. 1, Grapevine Creek (no. 9 and 11, and at EMP 19.7), tributary to Grapevine Creek (no. 12), tributary to Cuddy Canyon Creek (no. 14), tributary to Liebre Gulch (no. 35), Liebre Gulch (no. 36), and Marple Canyon (no. 46). The erosion control devices shall be maintained regularly until disturbed soils are stabilized and then shall be removed along with accumulated sediment. The sediment shall be deposited and stabilized in a location where it is unlikely to re-enter the aquatic system. This measure applies to pipeline construction as well as to maintenance/repair activities requiring excavation within streams. The environmental monitors shall periodically assess the stream crossings and erosion control devices to ensure that no erosion or downstream sedimentation is occurring. If erosion along streambanks or increased sedimentation is occurring, additional control measures shall be implemented.

Impact: Construction or maintenance in streams or wetlands would degrade the aquatic habitats within the construction corridor. Vegetation and streambed substrate would be removed and the natural flow would be diverted. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 PPSI installs all necessary erosion control devices at the following stream crossings: unnamed drainage no. 1, Grapevine Creek (no. 9 and 11 and at EMP 19.7), tributary to Grapevine Creek (no. 12), tributary to Cuddy Canyon Creek (no. 14), tributary to Liebre Gulch (no. 35), and Marple Canyon (no. 46) to ensure that siltation and erosion do not occur. (Level 2) - During construction.

PC2 All erosion control devices are maintained until disturbed soils are stabilized. (Level 2) - During construction and post-construction, if necessary.

PC3 All erosion control devices removed along with accumulated sediment when disturbed soils stabilized. (Level 2) - During construction and post-construction, if necessary.

PC4 Sediment is deposited and stabilized where it cannot re-enter aquatic system. (Level 2) - During construction and post-construction, if necessary.

PC5 PPSI provides monitors' reports assessing erosion and sedimentation downstream of stream crossings. (Level 1) - During construction.

PC6 If erosion or increased sedimentation occur, then additional erosion control measures are installed within 24 hours of assessment. (Level 3) - During construction, within 24 hours of discovering erosion or increased sedimentation.

Effectiveness Criteria: Banks are stable; sediment is contained so as not to adversely affect aquatic habitats. Revegetation is initiated.

Mitigation Measure B-AQ-4: Remove all temporary fords and culverts placed in drainages for construction access as soon as no longer needed for that purpose. The streambed and banks shall be restored to their previous condition (slope, substrate type, and soil compaction) during the dry season (normally May through October) and prior to 1 November unless for emergency repairs. Compaction to 95 percent of pre-project density, where feasible, is generally considered sufficient to avoid lateral erosion problems. This measure applies to construction and to repairs within streams.

Impact: Construction or maintenance in streams or wetlands would degrade the aquatic habitats within the construction corridor. Vegetation and streambed substrate would be removed and the natural flow would be diverted. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 All temporary fords and culverts removed from drainages as soon as no longer needed for access. (Level 2) - During construction and post-construction.

PC2 Streambeds and banks restored to previous conditions between May 1 and October 31. (Level 2) - During construction (dry season).

PC3 One day prior to crossing streams or start of construction at streams (whichever comes first), PPSI provides report of compaction measurements of streambeds and banks. (Level 2) - Prior to construction.

PC4 PPSI provides report of locations where compaction to 95% of pre-project density will not be possible along with a detailed explanation of why not. (Level 2) - During construction.

PC5 PPSI provides report of compaction at streambeds and banks after crossing (should be compacted to 95% of pre-project density, where feasible). (Level 2) - During construction.

PC6 PPSI notifies CPUC/ANF designee and provides documentation, why revegetation work and emergency maintenance/repair is necessary at streams after November 1. For revegetation work, documentation and notification shall occur at least by October 1.

Effectiveness Criteria: Banks are stable; sediment is contained so as not to adversely affect aquatic habitats. Revegetation is initiated.

Effectiveness Timing: Plan review and approval prior to final design; implement during the dry season; implementation monitored during construction. Emergency maintenance/repairs can occur after November 1 as needed.

Mitigation Measure B-AQ-5: Include in the Oil Spill Contingency Plan (System Safety Mitigation Measure SS-9) measures to minimize impacts on stream habitats from cleanup activities and for restoration of the bed and banks where altered by these activities. Site-specific measures shall be included to reduce impacts in sensitive habitats such as the Santa Clara River and the Los Angeles Harbor area.

Impact: A large oil spill may affect a large area of stream channel such that bed or bank alteration resulting from contamination or cleanup activities reduces habitat quality for aquatic organisms. (Class I, II, or III)

Performance Criteria, Violation Level, and Timing:

PC1 OSCP describes in detail measures that will be taken to minimize impacts on streambeds and bank from cleanup procedures. (Level 1) - Prior to pipeline operation.

PC2 OSCP describes measures to be implemented for restoration of streambeds and banks that may be altered by cleanup procedures. (Level 1) - Prior to pipeline operation.

PC3 OSCP includes site-specific measures (along with detailed drawings identifying where each site-specific measure would be implemented) to reduce impacts in sensitive habitats such as the Santa Clara River and the Los Angeles Harbor area. (Level 2) - Prior to pipeline operation.

Effectiveness Criteria: Effectiveness should be re-evaluated after an oil spill, OSCP revised if necessary. Restoration criteria consistent with ECRLP.

Effectiveness Timing: OSCP completed and approved prior to operations; effectiveness reviewed following implementation in response to an oil spill.

Mitigation Measure B-AQ-6: Develop (by the Applicant) a contingency plan to mitigate the potential loss of a population of a listed or proposed species resulting from an oil spill. This plan shall include monitoring of the habitat for 2 to 5 years as specified by the USFWS/CDFG to evaluate any habitat degradation and to determine if the population recovers from the spill. If the monitoring shows that the species population has been extirpated, the Applicant shall consult with the USFWS/CDFG to develop and implement a habitat restoration and species reintroduction program for the species using the most suitable genetic source. This would apply to aquatic species with isolated or limited distributions, such as unarmored threespine stickleback, California red-legged frog, and southwestern pond turtle that may be unable to naturally repopulate the affected habitat once the population is lost.

Impact: Oil spill may affect unarmored threespine stickleback or Santa Ana sucker populations. (Class I)

Performance Criteria, Violation Level, and Timing:

PC1 PPSI submits for approval a detailed contingency plan to mitigate the potential loss resulting from an oil spill of a population of listed or proposed aquatic wildlife species that occur downstream from the pipeline. The plan would be updated each time USFWS and/or CDFG listings change during lifetime of pipeline. (Level 2)

PC2 For each oil spill, PPSI provides monitoring reports of the habitat prepared by a qualified biologist for 2 to 5 years (as specified by the USFWS/CDFG) to evaluate any habitat degradation and to determine if the population recovers from the spill. (Level 2) - After each oil spill, for 2 to 5 years (as specified by USFWS/CDFG).

PC3 For each oil spill, if the monitoring shows that the species population has been extirpated, PPSI shall provide documentation of their consultations with the USFWS/CDFG to develop and implement a specific habitat restoration and species reintroduction program for the impacted species (aquatic species with isolated or limited distributions, such as unarmored threespine stickleback, California red-legged frog, and southwestern pond turtle) that may be unable to naturally repopulate the affected habitat once the population is lost. (Level 2) - After each oil spill.

PC4 For each oil spill, PPSI shall submit for approval a specific habitat restoration and species reintroduction plan. (Level 2) - Within 60 days after each oil spill.

PC5 For each oil spill, PPSI shall implement the approved specific habitat restoration and species reintroduction plan. (Level 2) - Within 10 days of receiving approval.

Effectiveness Criteria: Population recovers from the spill.

Effectiveness Timing: OSCP completed and approved prior to operations; effectiveness reviewed following implementation in response to an oil spill.

Mitigation Measure B-AQ-7: Conduct surveys at and downstream of pipeline crossings of Grapevine Creek and its tributaries for the Grapevine Creek snail at least 3 months prior to construction. If any are found, develop a contingency plan to protect the species during construction. The surveys shall be conducted by qualified biologists, and the Contingency Plan shall be developed by the Applicant.

Impact: Pipeline construction or an oil spill may affect habitat for the Grapevine Creek snail. (Class II or III)

Performance Criteria, Violation Level, and Timing:

PC1 PPSI provides survey reports from a qualified biologist. (Level 2) - 60 days prior to construction.

Mitigation Measure B-AQ-8: Prior to removal of the pipeline on National Forest System lands, all stream crossings shall be surveyed and a corresponding description of aquatic habitats shall be prepared. This description shall provide the basis for implementing Mitigation Measures B-AQ-1 through B-AQ-4 as applicable to pipeline removal.

Impact: Removal of pipeline as required for abandonment on ANF land may have impacts to streams or wetlands within the pipeline corridor similar to those of construction (Class II).

Performance Criteria, Violation Level, and Timing:

PC1 PPSI provides survey reports prepared by a qualified biologist with description of aquatic habitats on National Forest lands. (Level 2) - Prior to abandonment in the ANF.

PC2 Mitigation Measures B-AQ-1 through B-AQ-4, as applicable to unearthing and removing the pipeline, are implemented. (Level 2) - Prior to and during abandonment in the ANF.

Mitigation Measure B-W-1: Prior to the beginning of construction activities, surveys ("preconstruction surveys") shall be conducted along all pipeline segments that may support any of the following sensitive species. Surveys shall be conducted by an agency-approved wildlife biologist familiar with these species and their habitats. Surveys for the reptiles and amphibians shall be conducted when these species are known to be active.

The purpose of these pre-construction surveys would be to determine the presence or absence of each of the above-listed sensitive wildlife species on the project site(s); to determine the extent of suitable habitat within or adjacent to the pipeline corridor for each of these sensitive wildlife species; to document the locations of dens (for large mammals like the San Joaquin kit fox and American badger), and to evaluate the efficacy of subsequent clearance surveys for the more sedentary species.

Impact: Sensitive species and resources adjacent to the proposed route may be removed or degraded by construction, maintenance, repair, or emergency response. (Class I or II)

Performance Criteria, Violation Level, and Timing:

PC2 PPSI conducts preconstruction survey of potential habitat using accepted procedures for Tehachapi slender salamander, San Joaquin kit fox, California Red-legged frog, blunt-nosed Leopard lizard, and Tehachapi pocket mouse. If no individuals are found, construction may proceed in unoccupied habitat. If individuals are found, PC3 is to be followed.

PC3 If these species are found within the disturbance corridor during the preconstruction surveys, PPSI will have a qualified wildlife biologist conduct clearance surveys for these species approximately one week prior to construction (see B-W-2, PC2). Individuals found within the disturbance corridor will be relocated to similar, adjacent habitats at least 50 yards outside of the construction corridor.

Effectiveness Criteria: Minimal disturbance to San Joaquin Valley sensitive species during construction.

Effectiveness Timing: During construction.

Mitigation Measure B-W-2: Limit construction activities near sensitive habitats that have been found during preconstruction surveys to support the sensitive species listed below in Table C.3-10. One of two options may be used to avoid significant impacts on these species:

(1) Limit construction activities in areas where any of the species listed in Table C.3-10 are found to periods of inactivity when these species are underground below the depth of surface disturbance. If construction is scheduled to be completed when the species are inactive, then the thorough preconstruction surveys would not be necessary because impacts on individuals would be generally limited to only the actual area of the trench, which is approximately 3 feet wide and 5 feet. (It is assumed that inactive individuals outside of the specific trench area are generally below the depth of disturbance for ROW preparation.)

(2) If construction is scheduled through any of these sensitive species' habitats for the time period when they are known to be active, then, within one week of construction, an agency-approved wildlife biologist shall thoroughly search for and capture all individuals found in or immediately adjacent to the ROW. The captured individuals shall either be relocated to appropriate habitat outside of the disturbance corridor or shall be held in captivity until construction is completed through their habitat. The construction area shall be monitored during construction and appropriate measures taken to ensure that individuals of relocated species do not move into the construction corridor. The decision of whether to relocate the animals shall be made by the biologist in consultation with the Onsite Environmental Coordinator (OEC) on the basis of site-specific conditions that might influence the safety of the animals. For listed or proposed threatened or endangered species, mitigation activities would have to occur within the framework of the biological opinion (USFWS), memorandum of understanding (CDFG), or other permit or instruction coming from USFWS or CDFG pursuant to Federal or State endangered species legislation.

Impact: Construction may result in significant impacts on San Joaquin Valley-sensitive wildlife species. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 Construction abides by Seasonal Construction Limitations; Table C.3-10, (FEIS/SEIR 1/96, p C.3-71). (Level 2) - During construction.

PC2 If sensitive species are found during the clearance surveys, PPSI biologists will relocate individuals to suitable adjacent habitat at least 50 yards outside the disturbance corridor within 12 hours of capture. (Level 2) - Prior to construction.

Impact: Interruption of sensitive species breeding caused by nearby construction activity.

PC1 Construction near habitats of sensitive bird species (Table C.3-10a) occurs only between July and November only if courtship behavior and/or nesting has been established during the pre-construction wildlife surveys. (Level 2) - Between July 1 and October 31 during construction.

Mitigation Measure B-W-3: The following measures shall be incorporated for all project-related activity through areas that support sensitive species habitat and through the entire San Joaquin Valley segment. These measures are taken in part from the USFWS list of standardized recommendations for protecting the San Joaquin kit fox (USFWS, 1989).

Every attempt should be made to minimize the areas subject to permanent and temporary construction disturbances and other types of project-related disturbances. Prior to the start of construction the boundaries of the construction ROW should be clearly marked with stakes and flagging. Where feasible, all project-related vehicle traffic should be restricted to established roads and construction areas. Cross-country vehicle travel outside of the clearly delineated construction ROW should be prohibited.

To prevent the accidental entrapment and subsequent burial of sensitive ground dwelling animals in the pipeline trench, escape ramps constructed of earth fill or wooden planks inserted into the open trench at reasonable intervals should be provided for all open sections of the pipeline trench at the end of each working day. Prior to the start of construction each day a qualified wildlife biologist should inspect and remove any animals that have become trapped in the open pipeline trench during the preceding night. Also, all construction pipes, culverts, or similar structures that are stored on site or adjacent to the construction site for one or more nights should be thoroughly inspected for sensitive wildlife by a qualified wildlife biologist before the material is buried, capped, or otherwise used or moved.

To keep from attracting wildlife at night into the project site, all food-related trash such as wrappers, cans, bottles, and food scraps should be disposed of in closed containers and regularly removed from the construction site.

Pets of construction personnel (e.g., dogs and cats) should be prohibited from the project site to prevent possible harassment, mortality, or destruction of dens or burrows of endangered and sensitive wildlife species.

Construction personnel who accidentally kill or injure any State- or Federally-listed wildlife species (including Tehachapi slender salamander, blunt-nosed leopard lizard, San Joaquin antelope squirrel, and San Joaquin kit fox) or who find a dead, injured or entrapped listed wildlife species should report the incident immediately to the OEC. USFWS should be notified within three working days of the finding of any dead or injured listed species. Any kit foxes or other endangered species found dead or injured at the project site must be turned over immediately to the CDFG for care or analysis.

An employee education and compliance program should be implemented prior to the start of construction for all construction personnel that will be involved with construction of the San Joaquin Valley segment of the proposed pipeline route. This program should consist of a brief consultation in which individuals knowledgeable in the biology and legislative protections given San Joaquin Valley listed wildlife species explain endangered species concerns. This program should include a description of each of the listed species and their habitats, should address the occurrence of each species relative to the project site, and should identify all of the measures being taken to reduce impacts on listed species during project construction. A fact sheet which conveys this information about each of the listed species expected to occur in the project area should be prepared and distributed by PPSI to all contractors, their employees, and other project personnel involved with construction of the San Joaquin Valley segment of the Proposed Project.

To reduce the chances of endangered wildlife species being accidentally hit by construction vehicles, all construction vehicles should observe a 20 mph speed limit through the San Joaquin segment of the route within a clearly marked construction ROW, except along county roads and State and Federal Highways. To the extent possible, nighttime construction related activities should be kept to a minimum so as not to further impact the nocturnally active San Joaquin kit fox.

Impact: Construction may result in significant impacts on San Joaquin Valley - sensitive wildlife species. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 In San Joaquin Valley (MP 0.0 to MP 15.5) area subject to permanent and temporary disturbance is minimized; project-related traffic is restricted to established roads and construction areas; and no cross-country travel occurs. These measures are taken in part from the USFWS list of standardized recommendations for protecting the San Joaquin kit fox (USFWS, 1989).

Based on the results of the preconstruction surveys, where feasible, the project should be modified based on consultation with CPUC, ANF, USFWS, CDFG, or other jurisdiction as applicable to avoid or reduce anticipated impacts to listed San Joaquin Valley wildlife species.

Prior to the start of construction, protective buffer zones should be established around all known and potential San Joaquin kit fox dens. These buffer zones should be circular with a radius of specified distance measured outward from the den entrance or cluster of entrances. The size of these exclusion zones should be agreed upon in consultation with the USFWS and CDFG. Construction-related activities should be prohibited or greatly restricted within these exclusion zones. All construction, vehicle operation, materials storage, or any other type of surface-disturbing activity should be prohibited within these zones. To ensure adequate protection of San Joaquin kit fox dens in the project area, the exclusion zones should be encircled at the appropriate distance by USFWS-approved exclusion fencing (i.e., large flagged 4- to 5-foot metal or 1" X 1" wooden stakes connected by heavy rope or cord) (USFWS, 1989). Two to three signs explaining the fenced zone as environmentally sensitive habitat should be placed equidistant around the perimeter of each exclusion zone. Exclusion zone fencing should be maintained until all construction-related or operational disturbances have been completed at which time all fencing and signs should be removed. For potential kit fox dens, three 4- to 5-foot flagged stakes should be placed equidistant at points 10 to 15 feet from the den entrance, and a single sign beside one of the stakes will suffice to identify the dens as an environmentally sensitive area.

Wherever possible all San Joaquin kit fox dens should be avoided. However, in cases where it would be impossible to avoid a kit fox den, then limited destruction of kit fox dens may be permitted, provided the following procedures are observed. Prior to destruction of any known kit fox dens, the USFWS shall be notified in writing of the intent to destroy the subject den(s) and of the reasons why alternative less-intrusive actions are not possible. USFWS will review the proposal and will either concur or will recommend alternative methods to either avoid den destruction or to reduce impacts. Natal or pupping dens should be destroyed only after they have been abandoned following the November 1 to July 31 breeding season. Potential kit fox dens may be destroyed without notification of the USFWS if, based on a determination made by a trained, CPUC- and CDFG-approved biologist, there is no current or previous recent use of the den by kit foxes. All kit fox dens that will be unavoidably destroyed by construction of this pipeline shall be carefully excavated by or under the direct supervision of a qualified USFWS-approved wildlife biologist. Dens shall be completely excavated with hand tools and subsequently back-filled and compacted to prevent later use by kit foxes prior to start of construction. Monitoring of dens shall be conducted for at least three consecutive days prior to excavation to ensure that dens are not occupied by kit foxes when excavated. If a kit fox is inadvertently found inside a den during excavation, the animal(s) shall be allowed to escape unhindered. Within two weeks after completion of destruction of kit fox dens, the USFWS shall be notified in writing as to the results of all dens destroyed.

All areas of native San Joaquin Valley habitats disturbed during construction of this pipeline should be recontoured and revegetated to promote restoration to pre-project conditions. Methods and plant species to be used to revegetate areas of native San Joaquin Valley habitat disturbed by this project should be determined on a site-specific basis in consultation with USFWS, CDFG, and revegetation experts. To the extent possible, local plant species or plant species native to similar habitats in the San Joaquin Valley should be used. All disturbed areas should be regularly monitored and reseeded as necessary to ensure that they are returned to pre-project conditions. (Note: also see Mitigation Measure B-V-4.)

Any known kit fox den that is destroyed during construction should be replaced with an artificial den. Den design and placement should be determined on a site-specific basis in consultation with USFWS, CDFG, and kit fox experts. Any potential kit fox den found during its excavation to contain evidence of kit fox use would be subject to replacement.

If blunt-nosed leopard lizards or antelope ground squirrels repeatedly enter the cleared ROW, then barriers such as protective fencing or drift fences may have to be erected for the duration of construction in these areas to exclude these species from continuing to enter the cleared ROW or open pipeline trench. Suitable exclusion barriers for lizards and small mammals are described in Germano et al. (1993) and O'Farrell and Stoddard (1993).

Impact: Construction may result in significant impacts on San Joaquin Valley-sensitive wildlife species. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 PPSI provides documentation of modifications made to project in order to avoid or reduce anticipated impacts to listed San Joaquin Valley wildlife species. (Level 1) - Prior to start of construction.

PC2 PPSI establishes USFWS- and CDFG-approved protective buffer zones with exclusion fencing and signs around all potential and known San Joaquin kit fox (SJKF) dens. (Level 1) - Prior to start of construction in areas along ROW where surveys have identified occurrence of SJKF dens.

PC3 Construction activities do not occur in SJKF buffer zones. (Level 3) - Prior to start of construction in areas along ROW where surveys have identified occurrence of SJKF dens.

PC4 Exclusion fencing and signs around all potential and known SJKF dens maintained while construction-related disturbance occurs. (Level 2) - During construction in areas along ROW where surveys have identified occurrence of SJKF dens.

PC5 Exclusion fencing and signs around all potential and known SJKF dens removed at completion of construction-related disturbance or revegetation efforts. (Level 1) - After construction in areas along ROW where surveys have identified occurrence of SJKF dens.

PC6 San Joaquin kit fox dens are avoided. (Level 3) - During construction in areas along ROW where surveys have identified occurrence of SJKF dens.

PC7 Within 7 days of excavation and/or destruction of a known SJKF den, PPSI provides reports and communications verifying that USFWS procedures were followed. (Level 2) - During process of deciding to destroy known SJKF den until SJKF den is destroyed.

PC8 PPSI notifies USFWS in writing within two weeks after completion of destruction of the results of all SJKF dens destroyed. (Level 3) - Within 14 days after completion of destruction of SJKF dens

PC9 Any known SJKF den that was destroyed has been replaced by an artificial den that meets USFWS, CDFG, and SJKF experts' standards within 30 days of completion of construction at that site. (Level 2) - Post-construction in areas where known SJKF den that was destroyed.

PC10 Area in San Joaquin Valley recontoured and revegetated to promote restoration to pre-project conditions. (See also Applicant Proposed Measure B-V-4**) (Level 2) - Post-construction in areas of native San Joaquin Valley.

PC11 All disturbed areas in San Joaquin Valley are monitored every 6 months by qualified reclamation specialist and reseeded as necessary until area returns to pre-project conditions. PC12 Barriers such as protective fencing erected after blunt-nosed leopard lizards or San Joaquin antelope squirrels repeatedly (more than 15 times) entered cleared ROW or open trench. (Level 2) - During construction in areas along ROW where surveys have identified occurrence of blunt-nosed leopard lizards or San Joaquin antelope squirrels.

Effectiveness Criteria: Minimal disturbance to San Joaquin Valley sensitive species during construction.

Effectiveness Timing: During construction.

Mitigation Measure B-W-5: If preconstruction surveys have identified red-legged frogs, southwestern pond turtles, or two-striped garter snakes within or adjacent to the ROW, then, no more than one week prior to the start of construction in these areas, the animals shall be captured by an agency-approved wildlife biologist. The captured individuals shall either be relocated to appropriate habitat outside of the disturbance corridor or shall be held in captivity until construction is completed through their habitat. The decision of whether or not to relocate the animals shall be made by the wildlife biologist in consultation with the OEC on the basis of site-specific conditions that might influence the safety of the animals. For the red-legged frog, mitigation activities would have to occur within the framework of the biological opinion (USFWS), memorandum of understanding (CDFG), or other permit or instruction coming from USFWS or CDFG pursuant to Federal or State endangered species legislation. The capture sites shall be monitored during construction to ensure that any relocated animals do not move back into the construction corridor. The construction area shall be monitored during construction and appropriate measures taken to ensure that individuals of relocated species do not move into the construction corridor.

Impact: Construction may result in significant impacts on San Joaquin Valley-sensitive wildlife species. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 PPSI provides capture plans and copies of necessary permits from USFWS/CDFG for each sensitive species (red-legged frogs, southwestern pond turtles, and two-striped garter snakes) prior to capture attempts. (Level 3) - Prior to start of construction.

PC2 PPSI has qualified biologist search for and capture all sensitive species (red-legged frogs, southwestern pond turtles, and two-striped garter snakes) in or immediately adjacent to ROW. (Level 3) - One week prior to start of construction in sensitive species (red-legged frogs, southwestern pond turtles, and two-striped garter snakes) areas.

PC3 PPSI provides report by qualified biologist on status of captured animals and maps of release sites. Release to occur within 12 hours of capture. (Level 3) - During construction in sensitive species (red-legged frogs, southwestern pond turtles, and two-striped garter snakes) areas.

PC4 PPSI monitors construction area to ensure relocated individuals do not return to construction corridor. (Level 2) - During construction in sensitive species (red-legged frogs, southwestern pond turtles, and two-striped garter snakes) areas.

PC5 For each sensitive species animal that returns to the construction area, PPSI provides report from qualified biologist on details of capture and relocation to appropriate habitat outside the disturbance corridor. Relocation to occur within 12 hours of capture. (Level 3) - During construction in sensitive species (red-legged frogs, southwestern pond turtles, and two-striped garter snakes) areas. Relocation to occur within 12 hours of capture.

Effectiveness Criteria: Minimal disturbance to San Joaquin Valley sensitive species during construction.

Mitigation Measure B-W-6: Preconstruction surveys for the bird species listed in Table C.3-11 are not necessary if construction is scheduled to be completed during the non-breeding season. However, if construction is scheduled to occur between the mileposts listed below during the breeding season, surveys for nesting birds shall be conducted in that same season before construction begins. If nesting birds are found, then construction activity shall be delayed or rescheduled within 100 to 500 feet of the nest to avoid disturbance to the nest. The buffer distance between construction activity and the nest shall be decided by the agency-approved biological monitor and shall depend upon site-specific factors including the vulnerability of the nest to construction activity and the presence of other nearby disturbances. Construction activity may resume when it is determined by the biological monitor that the young have fledged and/or nesting in the area is completed.

The OSCP shall also provide stipulations for development and implementations of site specific habitat restoration plans and other site-specific and species-specific measures appropriate for mitigating impacts on local populations of sensitive wildlife species. Access and egress points, staging areas, and material stockpile areas that avoid sensitive habitats shall be identified. Effectiveness Criteria: Plan must satisfy reviewers that it is implementable, provides sufficient detail, addresses likely scenarios, and provides maximum feasible mitigation; wildlife habitat recovers from oil spill impacts.

Mitigation Measure B-W-7: During preconstruction surveys, burrowing owl burrows outside but adjacent to the ROW shall be flagged to ensure that they are not disturbed. Within the ROW, unoccupied burrows shall be covered to prevent owls from reoccupying the burrows prior to construction. Occupied burrows in the ROW shall be hand-excavated preferably before or after the reproductive season (May-July) to remove animals from harm's way. The burrows shall then be covered to assure animals will not return.

Impact: Construction may impact Federally or State-listed as threatened or endangered species or sensitive species with locally vulnerable populations. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 Burrowing owl dens outside, but adjacent to, ROW are flagged and unoccupied dens within the ROW are covered. (Level 2) - Prior to construction (during preconstruction surveys).

These surveys shall be performed by a CPUC- and ANF-approved wildlife biologist prior to the start of construction through areas that contain suitable badger habitat (e.g., annual grassland, Atriplex scrub, oak savanna, and open coastal sage scrub). Active badger dens outside but adjacent to the ROW shall be flagged for avoidance. Within the ROW, unoccupied dens shall be destroyed to prevent badgers from reoccupying the dens prior to construction. Occupied dens in the ROW shall be hand-excavated before or after the reproductive season (February-May) to make badgers leave. The dens shall then be closed to assure animals will not return.

Mitigation Measure B-W-10: Describe in the OSCP, where feasible, low-impact site-specific cleanup techniques such as hand cutting contaminated vegetation and using low-pressure water flushing from boats to remove oil from particularly sensitive wildlife habitats (e.g., riparian woodlands, lakes, and streams), because more destructive techniques such as shoveling, bulldozing, raking, and drag-lining can cause more damage to a sensitive habitat than the oil spill itself. Site-specific cleanup methods used shall be determined by the Incident Commander in consultation with the appropriate agencies including USFWS and CDFG. The OSCP shall evaluate the no-cleanup option for ecologically vulnerable habitats such as riparian habitats.

Impact: A large oil spill may affect a large area of sensitive species habitat or a significant number of individuals. (Class I or II)

Performance Criteria, Violation Level, and Timing:

PC1 OSCP describes in detail and with references accepted low-impact, site-specific cleanup techniques that will be employed when removing oil from sensitive wildlife habitats such as riparian woodlands, lakes, and streams. (Level 1) - Prior to pipeline operation.

PC2 During preparation for oil spill clean-up operations, the Incident Commander will consult with USFWS and CDFG prior to instituting clean-up methods. (Level 3) - Prior to oil spill response operation in sensitive wildlife habitats.

PC3 OSCP evaluates the no cleanup option in detail for ecologically vulnerable habitats. (Level 1) - Prior to pipeline operation.

Effectiveness Criteria: Effectiveness should be re-evaluated after an oil spill, OSCP revised if necessary. Restoration criteria consistent with ECRLP.

Effectiveness Timing: OSCP completed and approved prior to operations; effectiveness reviewed following implementation in response to an oil spill.

Mitigation Measure B-W-11: The OSCP shall identify appropriately trained personnel and equipment to respond to an oil spill pursuant to 40 CFR 194, Response Plans for Onshore Pipelines. In addition, pursuant to Title 14 Subdivision 4 (Office of Oil Spill Prevention and Response) of the California Department of Fish and Game Government Code, the OSCP shall discuss procedures that clearly outline how rehabilitation of oiled wildlife will be accomplished and assure by contract, or other approved means, the equipment and personnel necessary to implement these procedures. The OSCP shall incorporate wildlife contingency measures into the OSCP including specifics of how to deal with oiled wildlife, both terrestrial and aquatic; a list of names and telephone numbers of persons who are expert in the rehabilitation of oiled wildlife; locations and response times of facilities and persons for responding to oiled wildlife, creating facilities if necessary; and providing for the ability to rehabilitate oiled wildlife over the long term, if necessary.

Impact: A large oil spill may affect a large area of sensitive species habitat or a significant number of individuals. (Class I or II)

Performance Criteria, Violation Level, and Timing:

PC1 OSCP abides by 40 CFR 194 and CDFG Government Code Title 14 Subdivision 4. (Level 2) - Prior to pipeline operation.

PC2 PPSI incorporates into OSCP wildlife contingency measures based on specific information on rehabilitation, care and housing of oiled wildlife and including list of CDFG-recognized oiled wildlife care personnel and facilities. (Level 1) - Prior to pipeline operation.

PC3 PPSI establishes fund to ensure funding for all necessary cleanup measures and oiled wildlife care, including funding for creating new facilities and supporting the ability to rehabilitate oiled wildlife until that last impacted, rehabilitated animal is released. (Level 2) - Prior to pipeline operation.

Effectiveness Criteria: Effectiveness should be re-evaluated after an oil spill, OSCP revised if necessary. Restoration criteria consistent with ECRLP.

Mitigation Measure B-W-12: Prior to removal of the pipeline on National Forest System lands, the project alignment shall be surveyed by a ANF-approved wildlife biologist for any sensitive wildlife species occurring along the route. The results of the survey shall provide the basis for implementing Mitigation Measures B-W-2, B-W-4, B-W-5, and B-W-6 as applicable to pipeline abandonment.

Impact: Removal of pipeline as required for abandonment on ANF land may have impacts similar to those of construction, and may affect species whose status has changed in the years since construction. (Class II)

Performance Criteria, Violation Level, and Timing:

PC1 PPSI provides survey reports prepared by a qualified wildlife biologist with the description of any sensitive wildlife species on National Forest lands. (Level 2) - Prior to abandonment of pipeline in Angeles National Forest.

PC2 Mitigation Measures B-W-2, and B-W-4 through B-W-6, as applicable to unearthing and removing the pipeline, are implemented. (Level 2) - Prior to and during the abandonment of pipeline in Angeles National Forest

BIOLOGY APPLICANT PROPOSED MEASURES

Applicant Proposed Measure B-1**: Placement of the pipeline within the to-be-constructed Old Road extension, thereby avoiding adjacent valley oak woodland and coastal sage scrub habitats at EMP 62-67.

Impact: Sensitive species and resources adjacent to the proposed route may be removed or degraded by construction, maintenance, repair, or emergency response (Class I or II)

Performance Criteria, Violation Level, and Timing:

PC1 Pipeline placed within the to-be constructed Old Road extension. (Level 2) - During construction.

Effectiveness Criteria: Sensitive resources are fully avoided.

Effectiveness Timing: Resource avoidance confirmed during and after construction.

Applicant Proposed Measure B-2**: Placement of block or check valves so as to lessen the potential volume and effects of oil spilled in the event of a break in the pipeline (see Section C.13 for locations).

Impact: Oil spilled in the event of a break in the pipeline contaminating soil and causing damage or mortality to sensitive resources.

Bulldozers would maintain their blades in a raised position except at areas specifically designated for clearing in order to prevent unintentional damage to vegetation.

Applicant Proposed Measure B-7**: Preparation of an Erosion Control, Revegetation, and Landscaping Plan (LWRC, 1994a), to be approved by the CPUC and ANF, which will provide for post-construction habitat restoration to the satisfaction of the landowner and responsible agencies. The draft plan prepared by PPSI contains initial recommendations on seed mixes and revegetation and erosion control methods (including methods for stream crossings, with reestablishment of native riparian species where they are removed).

Impact: Potential erosion/sedimentation impacts on native vegetation as a result of construction.

PC1 PPSI designates an approved qualified reclamation specialist who oversees revegetation and erosion control (Level 2) - During revegetation.

Effectiveness Criteria: No or reduced impacts from erosion/sedimentation to native vegetation.

Effectiveness Timing: Specialist designated prior to construction and is active during construction and revegetation.

Applicant Proposed Measure B-9**: Prohibition of (1) refueling and lubrication of construction equipment within 0.25 mile of any stream or wetland; and (2) storage of more than 2 barrels of fuel within 0.5 mile of sensitive streams or wetlands. Equipment would be regularly checked for leakage.

BIOLOGY PROJECT PARAMETERS

B-PP1 Vegetation will be chipped for use as mulch in revegetation efforts along the ROW. Trees larger than four inches in diameter will be cut to manageable lengths and stacked along the ROW for use by the landowner or the managing agency.
