Dear Mr. Shauers:
We have reviewed Variance Request #110 for Sunday construction on Segment 2C (Templin Highway to southern ANF boundary) and 24-hour construction at the Whitaker Pressure Relief Station during concrete work (also included within Segment 2C), and approve your request, based on the following factors:
- All applicable mitigation measures for the project shall be implemented at the subject location, including implementation of noise abatement measures.
- Prior to the commencement of Sunday or 24-hour construction at the Whitaker Pressure Relief Station, the provisions of the CPUC and ANF approvals for tank elimination (dated July 13 and 14, 1998, respectively) shall be implemented.
- All noise complaints received shall be filed immediately with ANF and the CPUC/ANF Environmental Monitor for consideration. Failure to file any noise complaint(s) shall result in the immediately cessation of construction as allowed under this variance approval.
- 48-hour notice shall be provided to the CPUC/ANF Lead Environmental Monitor prior to the commencement of Sunday and 24-hour construction.
- Implementation of this variance approval in accordance with the provisions noted above shall be verified on a random basis by a CPUC/ANF Environmental Monitor.

RE: Variance Request #110 - Allow for Sunday construction on Segment 2C (Templin Highway to southern ANF boundary) and 24-hour construction at the Whitaker Pressure Relief Station during concrete work (also included within Segment 2C).
Dear Mr. Shauers:
We have reviewed the above-referenced variance request, and our decision of approval is based on the following factors:
PPSI is requesting that Sunday construction be allowed from now until the completion of Segment 2C which traverses primarily ANF lands, but also approximately 600 feet of private lands. As required by the ANF, project construction, including clean-up and revegetation, must be completed by October 3, 1998.
24-hour construction at the Whitaker Pressure Relief Station would only be conducted until concrete work at the station is completed.
In accordance with Mitigation Measure N-1, pipeline construction activities shall occur between 7:00 a.m. and 7:00 p.m., Monday through Saturday (or for a shorter period if stipulated by applicable noise ordinance). This project mitigation measure is in place to minimize the noise impact resulting from construction activities on sensitive receptors (residences, schools, churches, businesses, etc.). However, since Segment 2C traverses open terrain with no nearby sensitive receptors and since weekend recreation is limited in the area of concern, no significant noise impact would result from the proposed Sunday and 24-hour construction.
