RE: Variance Request #117 - Allow for Sunday construction on the Tejon Bench (between station numbers 873+32 and 1057+33), Kern County (Segment 1).

Dear Mr. Shauers:

The CPUC has reviewed the above-referenced request and approves your request, based on the following factors:

• In accordance with Mitigation Measure N-1, pipeline construction activities shall occur between 7:00 a.m. and 7:00 p.m., Monday through Saturday (or for a shorter period if stipulated by applicable noise ordinance).

• The Tejon Bench is located adjacent to the east side of northbound Interstate 5. No residences or businesses are located along or near the Tejon Bench. The Noise Element - Kern County General Plan (December 1989) allows for Sunday construction within this designated "Insensitive Land Uses" area.

• The following measures shall be implemented:

- All applicable mitigation measures for the project shall be implemented at the subject location.

- Prior to the commencement of Sunday construction, written land owner approval shall be provided to the CPUC Environmental Monitor.

- 48-hour notice shall be provided to the CPUC Lead Environmental Monitor prior to the commencement of Sunday construction.

- Implementation of this variance approval in accordance with the provisions noted above shall be verified on a random basis by a CPUC/ANF Environmental Monitor.
