RE: Variance Request #122 - Allow for Sunday construction at the Emidio and Grapevine Pump Stations (Segment 1), El Segundo Station (Segment 4B), and Wilmington Station (Segment 5).
Dear Mr. Shauers:
We have reviewed the above-referenced variance request, and approve your request based on the following factors:
• In accordance with Mitigation Measure N-1, pipeline construction activities shall occur between 7:00 a.m. and 7:00 p.m., Monday through Saturday (or for a shorter period if stipulated by applicable noise ordinance). Construction seven days a week has been requested by PPSI to facilitate the completion of construction at these locations.
• The Emidio and Grapevine Pump Stations are located in rural Kern County within lands classified by the Kern County General Plan as "Insensitive Land Uses." The Noise Element - Kern County General Plan (December 1989) provides guidelines for noise and does not prohibit Sunday construction within designated "Insensitive Land Uses" areas. No residences are located within 500 feet of either pump station site. No land use impacts are anticipated at these locations.
• The El Segundo Station and Wilmington Station are located within the boundaries of the Chevron El Segundo Refinery and Tosco Refinery, respectively. Surrounding land uses are also industrial in nature. No land use impacts are anticipated at these locations
• The measures noted below shall be implemented:
- All applicable mitigation measures shall be implemented during Sunday construction at each proposed location, including noise abatement.
- Sunday construction shall be limited to the requested station sites and shall be conducted in accordance with the requirements of Mitigation Measure N-1 and approved Variance Request #119 (allows 6:00 a.m. start time at the Emidio and Grapevine Pump Stations).
- Implementation of this variance in accordance with the provisions noted above shall be verified on a random basis by a CPUC/ANF Environmental Monitor.
