RE: Variance Request #33 - Use of solar/battery powered traffic signs in lieu of alternatively fueled vehicles as required by Mitigation Measure A-4.

Dear Mr. Shauers:

We have reviewed the above-referenced variance request and approve your request based on the following factors:

• Solar/battery powered traffic signs would have a net beneficial air quality and noise impact in comparison to the use of alternatively fueled vehicles and gasoline/diesel generator powered signs.

• The following measures shall be implemented:

- Solar/battery powered signs shall be used at each construction spread for the duration of construction.

- Implementation of this variance in accordance with the provisions noted above shall be verified on a random basis by a CPUC/ANF Environmental Monitor.
