RE: Variance Request #36 - Modify the Storm Water Pollution Prevention Plan to allow for the storage of more than one truck load of pipe on the right-of-way.

Dear Mr. Shauers:

We have reviewed the above-referenced variance request and deny your request based on the following factors:

• The Storm Water Pollution Prevention Plan already provides adequate flexibility for the contractor to construct the pipeline in an efficient manner (e.g., stringing of multiple truck loads of pipe); therefore, storage of multiple loads of pipe within the right-of-way is not required, as confirmed by your contractor ARB.

• PPSI has not demonstrated that uncertainties in pipe delivery from the main storage yard in Fontana has resulted in a delay in construction to date.
