RE: Variance Request #59 - Allow for construction between 5:30 p.m. and 6:00 a.m., seven days a week, at the Metrolink Central Maintenance Facility at Taylor Yard, City of Los Angeles (Segment 3).

Dear Mr. Shauers:

We have reviewed the above-referenced requests and approve your requests, based on the following factors:

• Metrolink is requiring nighttime construction within Taylor Yard to avoid disruptions to rail traffic in the area and potentially significant safety hazards to train operations and construction.

• Taylor Yard is located within an industrial area of the City of Los Angeles. As per Section 41.40(b) of the Los Angeles Municipal Code, a nighttime variance is necessary only if the proposed activity occurs within 500 feet of residential buildings. Since Taylor Yard is not within close proximity to any residential areas, no approval from the Los Angeles Police Commission is required (letter from Charles F. Kunz, Lieutenant, Los Angeles Police Department, dated March 27, 1998). No noise impact from the proposed nighttime construction is expected.

• The following measures shall be implemented:

- All applicable mitigation measures for the project shall be implemented at the subject location.

- All businesses within 300 feet of construction activities within Taylor Yard shall be notified of the proposed nighttime construction, seven days a week, prior to the commencement of such construction. All noise complaints received shall be filed immediately with the Los Angeles Police Department, Metrolink, and CPUC Lead Environmental Monitor for consideration. Failure to file any noise complaints shall result in the immediate cessation of construction as granted under this variance approval.

- Implementation of this variance in accordance with the provisions noted above shall be verified on a random basis by a CPUC/ANF Environmental Monitor.
