RE: Variance Request #63 - Allow for construction between 7:00 p.m. and 7:00 a.m., five days a week, at The Old Road and Magic Mountain Parkway between station numbers 3375+91 and 3445+84, County of Los Angeles (Segment 2B).

Dear Mr. Shauers:

We have reviewed the above-referenced requests and approve your requests, based on the following factors:

• On April 7, 1998, the Los Angeles Department of Public Works observed severe traffic congestion at the intersection of The Old Road and Magic Mountain Parkway due to pipeline construction. As a result, the County is requiring that construction occur during the night or under severely restrict hours (Inspection Notice, dated April 7, 1998). As a result, construction along this portion of Segment 2B has been shut down.

• Construction in the vicinity of Magic Mountain Parkway and The Old Road is an area of intense traffic during daylight hours when Magic Mountain is open for business. Nighttime construction after the close of the park would prevent traffic problems that could potentially affect Interstate 5 and the surrounding area. The area of nighttime construction has no residential areas and most businesses would be less affected by the nighttime construction activities. No noise impact from the proposed nighttime construction is expected.

• The following measures shall be implemented:

- All applicable mitigation measures for the project shall be implemented at the subject location.

- All businesses within 300 feet of construction activities along the subject portion of Segment 2B shall be notified of the proposed nighttime construction between 7:00 p.m. and 7:00 a.m., five days a week, within 24-hours of the date of this variance approval. Failure to provide notification shall result in the immediate cessation of construction as granted under this variance approval.

- Noise abatement measures shall be implemented during construction in accordance with the County Noise Control Ordinance. All noise complaints received shall be filed immediately with the Los Angeles County Department or Public Works and the CPUC Lead Environmental Monitor for consideration. Failure to file any noise complaints shall result in the immediate cessation of construction as granted under this variance approval.

- Implementation of this variance in accordance with the provisions noted above shall be verified on a random basis by a CPUC/ANF Environmental Monitor.
