Dear Mr. Shauers:

We have reviewed Variance Request #85 to extend the construction hours on the Angeles National Forest (ANF) to 5:00 a.m. to 8:00 p.m. between Mileposts (MP) 33 and 56.8, Monday through Saturday (Segment 2A), and approve your request, based on the following factors:

• In accordance with Mitigation Measure N-1, construction is allowed between 7:00 a.m. to 7:00 p.m., Monday through Saturday. The PPSI contractor is currently proposing to work from 7:00 a.m. to 5:30 p.m., Monday through Saturday on the ANF.

• The Forest Service has limited construction hours during the "High Fire Danger" season during July and August or on "High Level" days at other times of the year. This limitation could result in work stoppages at 1:00 p.m., as was experienced during 1997 construction.

• No residences live within 300 feet of the project right-of-way through the ANF. However, the Paradise Ranch Development is within close proximity to access routes to the right-of-way (MP 49 to MP 50.9). In addition, several businesses and homes are located on Castaic Road, the likely southern access route into the ANF.

• Under Variance Request #1, the need for extended construction hours along Segment 2A due to Forest Service 1997 fire season restrictions was approved by the ANF on June 26, 1997.

• The following measures shall be implemented:

- All applicable mitigation measures for the project shall be implemented at the subject location.

- Pipe trucks and equipment trucks shall not use the Old Ridge Route access or Castaic Road access before 7:00 a.m.

- As proposed, signs to notify the public of construction activities will be posted close to the Paradise Ranch Development at least two weeks prior to construction in the area. Signs shall have a contact phone number for PPSI.

- As proposed, construction activities shall be limited to 7:00 a.m. to 7:00 p.m. between Old Ridge Route (Milepost 49) and the Templin Highway crossing (Milepost 50.9).

- Implementation of this variance in accordance with the provisions noted above shall be verified on a random basis by a CPUC/ANF Environmental Monitor.
